1. This matter is taken up through hybrid mode.

2. Series of accommodations had been made by this Court for the appellant even on 06.09.2022 we had passed the order in absence of learned counsel for the appellant that if there is no representation for the appellant on the next date, this Court will be persuaded to pass an order for non-prosecution.

3. Notwithstanding the said order dated 06.09.2022 none appears for the appellant today. However, Mr. P.S.Das, learned counsel appears for the respondent.

4. We are having no other alternative, but to dismiss the appeal for non-prosecution.

5. Accordingly, it is ordered.
