Heard Mr.R.K.Routray, learned counsel for the petitioner and Mr.Zafarulla, learned Addl.

Standing Counsel.

On instruction Mr.Zafarulla, learned Additional Standing Counsel submits that on completion of investigation in connection with Mangalabag P.S. Case No. 14 of 2021 charge sheet No. 60 dated 27.2.2021 has already been filed before the jurisdictional Court under Sections 448, 341, 323, 294, 506, 427/34 of the I.P.C. 3.

Mr. Routray, learned counsel for the petitioner submits that though F.I.R. was registered under Section 379 I.P.C. however, charge sheet has not been filed for commission of such offence. In such background he submits that liberty may be granted to the petitioner to file a protest petition before the jurisdictional Court. 4.

Considering such submissions and without expressing any opinion on the merits of the case, this Court

// 2 // grants liberty to the petitioner to file a protest petition before the Jurisdictional Magistrate. In the event, such petition is filed before the Jurisdictional Magistrate, the said Court is directed to proceed with the same in accordance with law.

Accordingly the CRLMP is disposed of.

Urgent certified copy of the order be granted on proper application.
