It is alleged that the Petitioner's land has been seriously disturbed for construction of a road by the Opposite Party Nos.1 & 3. Through Annexure-4 it has been brought to the notice of this Court that though the representation at the instance of the Petitioner is already directed to the Collector, Kendrapara-Opposite Party No.6, but copy of the same is already received by the Office of the Executive Engineer, Minor Irrigation, Jajapur-Opposite Party No.3. It is alleged that in spite of receipt of such complaint, there is no examination of the complaint and consequentially there is no outcome.

Considering the allegation made by the Petitioner to be a serious one and since a decision in such matter is required to be taken by the Opposite Party No.1 with the involvement of the Opposite Party No.3, this Court observes, in the event there is no decision on the complaint of the Petitioner, decision as appropriate be taken involving the Petitioner within a period of two months from the date of
// 2 // communication of an authenticated copy of this order alongwith a copy of the writ petition by the Petitioner. It is further directed that till such period there will be no progress involving such construction. 3.
