This matter is taken up through Hybrid mode.

None appears for the Petitioner at the time of call. Mr. Gochhayat, learned CGC is present.

As it appears, the matter is pending since 2012 and interim order dated 4th October, 2012 is continuing.

On perusal of the order sheet, it appears that after issuance of notice and grant of interim order, the matter was listed on 5th November, 2012. On that date, the matter was adjourned at the instance of the Petitioner. During all these days, the Petitioner has not taken any step to get the matter listed. Today, none appears for the Petitioner when the matter is called. Thus, it appears that the Petitioner has lost interest in pursuing the matter. 5.

In view of the above, the writ petition is dismissed for non-prosecution.

Interim order dated 4th October, 2012 passed in Misc. Case No.16332 of 2012 stands vacated.

Issue urgent certified copy of the order on proper application.
