This matter is taken up through hybrid mode.

The Petitioner in this writ petition prays for a direction to set aside the order dated 19th March, 2020 passed by the Settlement Officer, Major Settlement, Cuttack-Opposite Party No.2 in Appeal Case No.46 of 2016, whereby he confirmed the order passed by Assistant Settlement Officer in Objection Case No.8205/161 of 2012.

In course of hearing, Mr. Nayak, learned counsel for the Petitioner prays for withdrawal of the writ petition to avail the remedy of revision under the provisions of Odisha Survey and Settlement Act, 1958.

Considering such submission, this writ petition is disposed of as withdrawn.

If the revision petition is filed within a period of three weeks hence, the delay may be construed liberally taking into consideration the pendency of the writ petition before this Court along with other grounds.

Certified copy of the impugned order under Annexure3 shall be returned to Mr. Nayak, learned counsel for the Petitioner on substitution of attested photocopy thereof. Urgent certified copy of this order be granted on proper application.
