This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Heard learned counsel for both the parties.

This writ petition has been filed by the Petitioner seeking the following relief:
"In view of the aforesaid facts and circumstances as narrated above it is prayed that this Hon'ble Court be graciously be pleased to admit the writ petition and issue rule nisi for any other appropriate writs against the opp. Parties calling upon the opposite parties to show cause as to why they shall not be directed to enroll the petitioner in the GPF as well as Pre-2005 Provisions of OCS (Pension) Rules, 1992.
And, if the Opp. Parties failed to show cause or show insufficient cause, make the said rule absolute by directing the Opposite Parties to enroll the petitioner in the GPF as well as Pre-2005 Provisions of OCS (Pension) Rules, 1992."

Learned counsel for the Petitioner submits that a representation in this regard has been submitted to the
// 2 // Commissioner-cum-Secretary to Government, Works Department, Bhubaneswar, Opposite Party No.1 dated 21.10.2021 (Annexure-7), which according to the Petitioner is still pending for consideration. 5.
Having heard learned counsel for the parties and considering the limited nature of request involved in this matter, the writ petition stands disposed of with a direction to the Commissioner-cumSecretary to Government, Works Department, Bhubaneswar, Opposite Party No.1 to consider the representation of the Petitioner vide Annexure-7, in accordance with law, if the same is still pending and take a lawful decision thereon, within a period of two months from the date of communication of a certified copy of this order along with a copy of the writ petition by the Petitioner, giving opportunity of hearing to the Petitioner by passing a speaking and reasoned order thereon. Decision so taken be communicated to the Petitioner within a period of two weeks thereafter. 6.
With the above direction, the Writ Petition stands disposed of.

Issue urgent certified copy as per rules.
