1. This matter is taken up through hybrid mode. Order No.

2. Heard Mr. D. Naik, learned Senior counsel for the Petitioner and Mrs.J. Tripathy, learned Addl. Standing Counsel for the Vigilance Department.

3. The Petitioner is in custody since 31st March, 2022 in connection with Cuttack Vigilance P.S. Case No.21/2022 corresponding to V.G.R. Case No.15/2022 pending in the court of learned Special Judge, Vigilance, Cuttack, for the alleged commission of the offence under Sections 13(2) read with Sections 13(1)(b)/12 of P.C. Act.

4. It is alleged that he had amassed wealth grossly disproportionate to his known sources of income to the extent of 371%. It is submitted by Mr. Naik, learned Senior Counsel appearing for the Petitioner, that the assessment of income from different sources is entirely erroneous and contains several discrepancies. The income of the Petitioner, his wife and his two sons, who are Software Engineers, have not been taken into account. Further, the savings and assets created by the sons have also not been taken into account.

5. Mrs. J.Tripathy, learned Addl. Standing Counsel appearing for the Vigilance Department, has opposed the prayer for by submitting that investigating is going on and, hence, some further evidence may also come out showing guilt of the Petitioner.

6. Considering the above facts and the fact that investigation appears to have progressed substantially I am inclined to allow the prayer for bail. Let the Petitioner be released on bail in the aforesaid case on such terms and conditions as may be imposed by the Court in seisin over the matter including the condition that he shall appear before the trial court on each date of posting of the case without fail, he shall fully co-operate with the Investigating Officer in investigation of the case and he shall appear before the Investigating Officer as and when required by him.

8. The BLAPL is disposed of.
