Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody in connection with Kantamal P.S. Case No.53 of 2019 corresponding to Special Case (NDPS) No. 31 of 2019 pending in the Court of learned Additional District & Sessions Judge-cum-Special Judge, Kantamal for the alleged commission of offence under Sections 20(b)(ii)(C) of NDPS Act. 4.

Though the allegation is that the petitioner and some other persons were apprehended by carrying contraband ganja of more than commercial quantity, yet from the FIR, it appears that the petitioner was implicated on the basis of the statement of coaccused, namely, Subhransu Karmi and other co-accused persons, who stand on the same footing have been released on bail as per order passed by this Court in BLAPL No. 1089 of 2020, BLAPL No. 2038 of 2021 and BLAPL No. 7768 of 2021, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may

deem fit and proper to impose including the condition that he shall personally appear before the trial court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
