1. Learned counsel for the Petitioners who seek to quash the Order No.

complaint case in I.C.C Case No.1567 of 2012 pending before the Court of the learned S.D.J.M, Bhubaneswar, submits that the present case has been initiated within the jurisdiction of the Court of S.D.J.M., Bhubaneswar while no cause of action appears from the complaint petition seems to have taken place within the jurisdiction of Bhubaneswar and all relates to the jurisdiction in the District of Angul.

2. Having regard to the fact that the S.D.J.M, Bhubaneswar has no territorial jurisdiction to take up the matter, in view of the present position of the case it ought to have been taken up at Angul.

3. Learned counsel for the Opp.Party appears and submits that he has no instruction but in the meanwhile the case must have been transferred to the District of Angul.

4. However, keeping in view of the fact that the matter has been initiated within the territorial jurisdiction of Bhubaneswar, in case

// 2 // the same has not been transferred or taken up within the jurisdiction as reveals from the complaint, the same be taken up as such.
