This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are seeking pre-arrest bail in connection with G.R. Case No. 568 of 2022, arising out of Kendrapara Sadar P.S. Case No. 118 of 2022 pending in the Court of learned S.D.J.M., Kendrapara for the alleged commission of offence punishable under Sections 341/294/323/354-B/506/34 of the I.P.C.

Learned counsel for the State on the basis of the recitals of the Case Diary submits that Petitioner No.4-Agani Jena has criminal antecedent, this Court is not inclined to exercise its

jurisdiction under Section 438 Cr.P.C. qua petitioner no.4-Agani Jena.

The ABLAPL in respect of Petitioner No.4 stands rejected.

It is submitted by the learned counsel for the State that, Petitioner No.1-Rabindra Jena has criminal proclivity. Yet, taking into account it is directed that Petitioner No.1-Rabindra Jena, Petitioner2-Rama Chandra Jena, 3. Babu@ Babuli Jena, 5Debasish Jena and 6-Subhendu Kumar Jena shall be released on bail on surrendering within three weeks hence. The Learned Court in seisin over the matter to fix the terms and conditions as deemed just and proper.

Accordingly, the ABLAPL stands disposed of.

Urgent certified copy of this order be granted as per rules.
