1. This matter is taken up through hybrid mode. Order No.

2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

3. The Petitioner is in custody since 30th January, 2022 in connection with Kishorenagar P.S.

Case No.211/2021 corresponding to G.R. Case No.1148/2021 pending in the court of learned S.D.J.M., Athamallik for the alleged commission of the offence under Section 379 of I.P.C.

4. It is submitted that the Petitioner was entangled in the case only on the basis of the statement of the co-accused person. It is further submitted that two of the co-accused persons namely, Bablu @ Jagannath Dhal and Ranjan Pradhan, who stand on the same footing as the Petitioner, have been granted interim protection from arrest as per order passed by this Court in ABLAPL No.1529/2022.

5. Considering the submissions made, the materials on record and the fact that charge sheet has already been submitted in the case, I am inclined to allow the prayer for bail.

6. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear before the trial court on each date of posting of the case without fail.

7. The BLAPL is disposed of.

8. Urgent certified copy of this order be granted on proper application.
