This matter is taken up through hybrid mode.

The Petitioner in this writ petition seeks for a direction to the Authorized Officer-cum-A.C.F., Berhampur Forest Division, Ganjam-Opposite Party to dispose of confiscation proceeding in O.R. Case No.441 of 2019-20 within a stipulated time.

On 14th July, 2022, learned State Counsel made a statement that due to non-submission of inquiry report as well as prosecution report of the Range Officer, Khallikote Range, confiscation proceeding could not proceed. He, however, prayed for an adjournment to instruct the concerned Officer to supply the inquiry report as well as prosecution report at an early date.

Today, Mr. Mishra, learned Additional Standing Counsel, on instruction, submits that the inquiry report as well as prosecution report has already been submitted to the Authorized Officer-cum-A.C.F., Berhampur Forest Division, Ganjam-Opposite Party. He, further submits that the concerned
// 2 // Officer requires three months time for disposal of confiscation proceeding in O.R. Case No.441 of 2019-20.

Taking into consideration the submission made by Mr. Mishra, learned Additional Standing Counsel, this Court disposes of the writ petition with a direction that the Authorized Officer-cum-A.C.F., Berhampur Forest Division, Ganjam-Opposite Party shall do well to dispose of the confiscation proceeding in O.R. Case No.441 of 2019-20 in accordance with law as expeditiously as possible preferably by end of December, 2022 giving opportunity of hearing to the parties concerned.

Parties are directed to cooperate with the Authorized Officer-cum-A.C.F., Berhampur Forest Division, Ganjam for early disposal of the confiscation proceeding. Urgent certified copy of this order be granted on proper application.
