Mr. Dash, learned advocate appears on behalf of respondent no.3 and submits, impugned order dated 12th March, 2007 was refusal of interim measure under section 9 of Arbitration and Conciliation Act, 1996. Subsequently the disputes were refereed to arbitration.

Mr. Das, learned advocate, Additional Standing Counsel appears on behalf of respondent nos.4 and 5. 3.

None appears for appellant and other respondents. Court is convinced that in the circumstances reported by Mr. Das, appellant has lost interest.

The appeal is dismissed.
