1. This matter is taken up through hybrid mode. Order No.

2. Mr. S.K. Baral and associates enters appearance for the informant by filing Vakalatnama in Court today. The same be kept on record.

3. Heard learned counsel for the Petitioners and learned Addl. Standing Counsel for the State.

4. The Petitioners are in custody in connection with Banpur P.S.

Case No.117/2022 corresponding to G.R.

Case No.104/2022 pending in the court of learned J.M.F.C., Banpur

// 2 // for the alleged commission of the offence under Sections 147/148/294/323/324/325/326/307/427/379/149 of I.P.C.

5. It is alleged that the Petitioners being part of a mob dragged the driver of a car who was none other than the local M.L.A. and severely assaulted to him as also damaged his vehicle. There are materials on record to show that the public representative received certain injuries. However, as it appears that there have been allegations and counter allegations between the two groups wherein identical charges have been leveled against each other.

Be that as it may, considering the fact that practically nothing further remains to be done in so far as the investigation of the case is concerned coupled with the fact that the Petitioners are local persons as also taking into account the period of detention in custody, I am inclined to allow the prayer for bail.

7. Let the Petitioners be released on bail in the aforesaid case on such terms and conditions as may be imposed by the court in seisin over the matter including the condition that they shall appear before the trial court below on each date of posting of the case and in case of any single default, the said court shall pass appropriate orders to take him to custody again, they shall appear before the I.I.C. of Banpur P.S. once every Monday at 10.00 A.M. till submission of charge sheet and such fact shall

// 3 // be certified by the I.I.C. to the concerned court once every month.

8. The BLAPL is disposed of.

9. Urgent certified copy of this order be granted on proper application.
