This matter is taken up through Hybrid Mode.

Heard learned counsel for the parties.

The petitioners are seeking pre-arrest bail in connection with Bansada P.S. Case No. 113 of 2022 corresponding to G.R. Case No. 250 of 2022, pending on the file of the learned JMFC, Chandbali for commission of offence under Sections 427/ 294/ 323/ 324/354/379/307/506/34 of the I.P.C.

Taking into account the specific overt act as alleged against the petitioner no. 2-Ganesh Nayak, this Court is not inclined to exercise its jurisdiction under Section 438 Cr.P.C. vis-à-vis the said petitioner. The ABLAPL accordingly stands dismissed qua the Petitioner No.2 5.
Taking into account the nature of allegations and the role ascribed to the Petitioner Nos. 1,3,4,5,6 and 7, this Court directs that on surrendering within three weeks hence and moving for bail, they
shall be released on bail by the learned court in seisin over the matter on such terms as deemed just and proper.

Accordingly, the ABLAPL is disposed of.
