Heard Mr. A. Mishra, learned counsel for the petitioner and Ms. Bijaylaxmi Tripathy, learned Central Govt. Counsel. 3.

The petitioner has filed this writ petition seeking to quash the order dated 06.08.2014 passed in O.A. No. 768 of 2012, by which the Central Administrative Tribunal, Cuttack Bench has dismissed the original application filed by the petitioner as not maintainable. 4.

Mr. A. Mishra, learned counsel for the petitioner contended that this case is fully covered by the order of this Court in the case of Bansidhar Gochhayat v. Union of India, 2015 (I) OLR 12. 5.

In view of the above submission, the order dated 06.08.2014 passed by the Central Administrative Tribunal, Cuttack Bench, Cuttack in O.A. No. 768 of 2012 cannot sustain in the eye of law and the same is liable to be quashed and is hereby quashed. The matter is remitted back to the tribunal for fresh adjudication.
