Accordingly, the writ petition is disposed of, as infructuous. However, if any cause of action still survives, the petitioner is at liberty to pursue its remedy before the appropriate forum, if it is so advised, in terms of the agreement/DTCN, which is applicable to it and the same shall be disposed of keeping in view the ratio decided in the case of Somnath Behera v.
