This matter is taken up through Hybrid Arrangement (Virtual / Physical Mode).

Heard learned counsel for the Petitioner and learned counsel for the State.

This is an application for bail filed by the Petitioner under Section 439, Cr.P.C. in connection with Balliguda P.S. Case No.47 of 2021 corresponding to C.T. Case No.16 of 2021 pending in the Court of learned Special Judge-cum-Addl. District & Sessions Judge, Balliguda, involving offence Under Sections 20(b)(ii) C and 29 of the N.D.P.S. Act.

Learned counsel for the Petitioner submits that charge-sheet has already been filed in the case on 16.03.2021 and further charge has already been framed by the trial court. However, he further submits that the trial of the case is getting delayed and the Petitioner is unnecessarily languishing in jail custody. In such view of the matter, the learned counsel for the Petitioner does not want to press this bail application at this juncture with liberty to move a fresh bail
// 2 // application if the trial is not concluded within a time to be stipulated by this Court.

Considering such submission, the learned trial court is directed to expedite and conclude the trial of the aforesaid case as expeditiously as possible, preferably within three months from today. In the event, trial is not concluded within the aforesaid stipulated period, the Petitioner is at liberty to move his bail application afresh, and the same shall be considered and disposed of by the learned trial court on its own merit in accordance with law. 6.
