1. The grievance is the present petition is that the Additional Anganwadi Centre of Village Dasipur under Aul Block in the District of Kendrapara is of poor quality and is also not in conformity with 16 of the MGNREGA Act which requires such construction to be undertaken with the approval of the Palli Sabha of the Gram Panchayat.
2. While this petition was admitted on 10th December, 2018 an interim order was passed asking status quo to be maintained in respect of the construction of the Additional Anganwadi Centre.
3. Having heard learned counsels for the parties, the Court is of the view that the Additional Anganwadi Centre is meant to serve the children in the area and stopping its construction would serve useful purpose. If the concern is about the quality of construction, that can easily be tackled by involving
// 2 // representatives of the Palli Sabha in the work of supervision of the construction.
4. Accordingly, it is directed that the Collector, Kendrapara will constitute a Committee which will have, apart from the representatives of the local administration, the representatives of the Palli Sabha of the village in question. In order to supervise the completion of construction of the Additional Anganwadi Centre, one of the main purposes of the Committee would be to ensure the quality of construction. The Committee should be constituted not later than 4th April, 2022. The construction of the Additional Anganwadi Centre be taken up forthwith and completed within a period of six months thereafter.
5. The interim order is accordingly vacated and the writ petition is disposed of.
