This matter is taken up through Hybrid Arrangement.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner in this writ petition challenges the impugned Order No.1309 dated 15.03.2023 passed by the Chief District Medical Officer & Public Health Officer, Sundargarh directing for non-extension of lease agreement in respect of 24 hour medicine shop run by the petitioner inside the District Headquarters Hospital campus.

Learned counsel for the State submits that the State
// 2 // has filed Writ Appeal No.1290 of 2022 in the case of State of Odisha & others v. M/s. Jai Bharat Medicals wherein the Division Bench of this Court has stayed the order passed by the leaned Single Judge and the matte is pending for adjudication.

In such view of the matter, since the above Appeal is pending before the Division Bench is akin to the present petition, it will be proper for this Court to wait till a decision of the Division Bench is finally pronounced. 6.
List this matter on 24th of April, 2023.

In the interim, it is directed that no coercive action pursuant to order dated 15.03.2023 shall be taken against the petitioner till the next date.

Issue urgent certified copy of this order.
