The matter is taken up through hybrid arrangement Order No.
(virtual/physical) mode.

This is the second journey of the Petitioner who is in custody in connection with Sason P.S. Case No.105 of 2010 corresponding to S.T. Case No.05 of 2020 pending on the file of learned 1st Addl. Sessions Judge, Sambalpur, I/C. for commission of offence under Section -450366/376(2)(f) of the IPC, in filling this application under section 439, Cr.P.C. for reconsideration of his prayer for grant of bail to the Petitioner in the above mentioned case.

Heard learned Counsel for the Petitioner and learned Counsel for the State in OPID cases.

Keeping in view the submissions made, the record being perused; it is seen that the Petitioner had last moved the Trial Court for his release on bail on 05.11.2019 and in the meantime, the trial being made some progress is yet to be
// 2 // concluded. In view of the above, at this stage while being not inclined to reconsider the prayer for grant of bail to the Petitioner, the Application stands disposed of granting liberty to the Petitioner to renew his prayer afresh before the Trial Court citing all such developments which have taken place in the meantime in their proper perspective.
It is needless to observe that in the event, such a move is made, the same shall be considered on its own merit; further taking into account all such subsequent developments which have taken place in the meantime in their proper perspective and disposed of early in accordance with law. 5.
The BLAPL is accordingly disposed of.
Issue urgent certified copy as per rules.
