This matter is taken up through hybrid mode.

This contempt petition has been filed alleging noncompliance of the order dated 5th August, 2021 passed in W.P.(C) No. 7838 of 2021 by which this Court has directed the Tahasildar, Nilgiri to supply certified copy of the entire order sheet along with final order dated 30th March, 2013 passed in Mutation Case No.365 of 2013.

Mr. Mishra, learned Additional Government Advocate, on instruction submits that certified copy of the final order passed in Mutation Case No.365 of 2013 was supplied to the Petitioner on 10th August, 2021, i.e. within five days of passing of the order passed in W.P.(C) No.7838 of 2021. Suppressing the same, this contempt petition has been filed.

Mr. Mohanty, learned counsel for the Petitioner accepting the aforesaid factual position, begs unconditional apology for the fault committed by the Petitioner and prays for withdrawal of the

// 2 // contempt petition. In support of his contention, he files a memo in Court today, which is taken on record.

Taking into consideration the submissions of learned counsel for the parties, the contempt petition is permitted to be withdrawn subject to payment of cost of Rs.5,000/- (Rupees five thousand only) to the Tahasildar, Nilgiri within a period of fifteen days hence failing which the same shall be recovered by initiating a proceeding under the Orissa Public Demands Recovery Act, 1962.
