This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Heard learned counsel for the Petitioners as well as learned counsel for the State.

The writ petition filed with the following prayer: "Under the above circumstances, it is humbly prayed that the writ petition may be allowed.
And (A) A writ of mandamus or an appropriate writ may be issued commanding the opposite parties to take back the petitioners into service as similarly situated DLR/NMR /HR workers, namely, Arakhita Taria, Gangadhar Nayak and Bibhuti Pradhan, who were engaged after 12.04.1993 and whose names are also available in the information sheet under Annexure-1 have been taken back to service and are still continuing in service with all consequential benefits within a time to be stipulated by this Hon'ble Court."

Learned counsel for the Petitioners submits that ventilating their grievance, Petitioners have filed a representation before the
// 2 // Engineer-in-Chief, Rural Water Supply and Sanitation, Jal 'O' Parimal Bhawan, Bhubaneswar, Opposite Party No.2, dated 05.01.2022. It is submitted that the said representation is pending before the Authority till date and no decision has been taken on such representation.

Learned counsel for the State on the other hand submits that he has no objection if a direction is given to the Authority to consider and dispose of the said representation of the Petitioner within specific period of time.

Considering the limited nature of grievance and considering the facts and circumstances of the case, this Court directs the Opposite Party No.2 to consider the representation of the Petitioner dated 05.01.2022 (Annexure-5) strictly in accordance with law within a period of two months from the date of receipt of certified copy of this order. The Opposite Party No.2 shall dispose of the same by passing a speaking and reasoned order. Decision so taken be communicated to the Petitioner within a period of two weeks thereafter.

With the above direction, the writ petition stands disposed of.

Issue urgent certified copy of this order on proper application.
