This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioners are seeking pre-arrest bail in connection with G.R. Case No.35 of 2022 arising out of Puintala P.S. Case No.10 of 2022 pending in the Court of learned S.D.J.M., Balangir for commission of offence punishable under Sections 365/34 of IPC.

In respect of Petitioner No.1, it is stated that during the investigation, notice under Section 41A of Cr.P.C. was issued and responded to. And, as such there is no apprehension of arrest, the ABLAPL application of the petitioner is disposed of as not maintainable.

On perusal of the Case Diary and considering the submissions of the learned counsel for the petitioner and State, the statement of the victim, this Court directs that on surrendering within three weeks hence, the petitioner No.2 shall be released on bail. The Court in seisin to fix the terms.

Accordingly, the ABLAPL stands disposed of.
