Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 28.01.2022 in connection with Brajrajnagar P.S. Case No.136 of 2021 corresponding to C.T. Case No.1082 of 2021 pending in the Court of learned S.D.J.M., Jharsuguda for the alleged commission of offence under Sections 395/397 of IPC.

It is alleged that the petitioner being associated with several other persons entered into the factory by scaling the boundary wall and assaulted the security guard and thereafter removed the iron net from the store. It appears that two of the accused persons, who are similarly placed as the petitioner, have been released on bail as per order passed by this Court in BLAPL Nos. 5352 of 2021 and 5351 of 2021.

Having regard to the above facts, as also the period of detention of the petitioner in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the Court in seisin over the matter may deem fit
and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
