This matter is taken up through hybrid mode.

This petition has been filed by the Petitioner-wife for transfer of C.S. (MAT) Case No.06 of 2019 instituted at the instance of the Opposite Party-husband from the file of the learned Civil Judge (Senior Division), Padampur to the Court of Judge, Family Court, Bargarh. 3.

Heard the learned counsel for the Petitioner-wife. 4.

It is stated that Petitioner-wife had filed an application before the learned District Judge, Bargarh, which was registered as TRP Case No.02 of 2020 wherein she has prayed for transfer of the aforesaid C.S. (MAT) case from the file of the learned Civil Judge (Senior Division), Padampur to the Court of Judge, Family Court, Bargarh. But the leaned District Judge refused to entertain the same, as it has no such jurisdiction to transfer a case to the Judge, Family Court, Bargarh. The

// 2 // Opposite Party-husband had appeared and stated that he has no objection if the said C.S. (MAT) case is transferred to the Judge, Family Court, Bargarh.

Considering the aforesaid facts and submissions made, this Court directs that C.S. (MAT) Case No.06 of 2019 pending on the file of the learned Civil Judge (Senior Division), Padampur be transferred to the Court of Judge, Family Court, Bargarh. Both the Courts shall do the needful on production of the certified copy of this order. 6.

With the aforesaid order, this transfer petition stands disposed of.

Urgent certified copy of this order be granted on proper application.
