Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 16.10.2021 in connection with Baisinga P.S. Case No.302 of 2021 corresponding to S.T. Case No.252 of 2021 pending in the Court of learned 2nd Addl. Sessions Judge, Baripada for the alleged commission of offence under Sections 376D of IPC.

The allegation is that while the victim and her boyfriend were present at a place called, Kalama, the petitioner and two other persons came there and forcibly dragged them inside nearby jungle and committed rape on her one after another. The victim has described the occurrence vividly in her statement recorded under Section 164 Cr.P.C. That apart, all the three culprits have been identified in T.I. parade. All these show a strong prima facie case against the petitioner. 5.
In such view of the matter, I am not inclined to allow the prayer for bail, which is therefore rejected.

The BLAIL is accordingly rejected.
