This matter is taken up through hybrid arrangement Order No.
(virtual/physical mode).

Heard learned counsel for the Petitioner and learned counsel for the State.

Considering the submission and on going through the materials as placed as well as nature of accusations; further keeping in view the fact that the Petitioner being the driver of the vehicle from which the food articles recovered have been found to be adulterated and in the absence of any such other impediment; it is directed that in the event of arrest of the Petitioner in connection with Malgodown P.S. Case No.40 of 2022 Corresponding to G.R. Case No.232 of 2022 pending in the court of learned J.M.F.C. (City), Cuttack, he shall be released on bail by the Arresting Officer on such terms and
// 2 // conditions as the Arresting Officer may deem just and proper with further conditions that he will cooperate with the investigation; shall not threaten or terrorize the prosecution witnesses in any manner and tamper the evidence. Violation of any of the above condition(s) shall entail cancellation of bail.

The ABLAPL is accordingly disposed of.
