Jagannath Satapathy v. Board Of Revenue
IN THE HIGH COURT OF ORISSA AT CUTTACK
W.P (C) No. 8891 of 2012 Jagannath Satapathy .....
Petitioner Mrs. Pami Rath, Advocate Vs.
Board of Revenue, CTC and another .....
Opposite parties Mr. J.Patnaik, G.A.
CORAM:
DR. JUSTICE B.R. SARANGI MISS JUSTICE SAVITRI RATHO
ORDER
22.03.2022 Order No.
This matter is taken up through hybrid mode.
2.
Heard Mrs. Pami Rath, learned counsel for the petitioner and Mr. J. Patnaik, learned Government Advocate. 3.
The petitioner has filed this writ petition challenging the order dated 04.05.2012 passed by the Orissa Administrative Tribunal, Bhubaneswar in O.A. No.1548 of 1991, by which the tribunal has declined to interfere with the order of termination of the petitioner.
4.
Mrs. Pami Rath, learned counsel for the petitioner, contended that by virtue of the interim order passed by the Tribunal as well as by this Court, the petitioner had been rendering his service and on attaining the age of superannuation has retired from service.
5.
In view of the above submission, since the petitioner has already retired from service on attaining the age of superannuation and till then he was discharging his duty on being protected by the interim orders passed by the tribunal as well as by this Court, nothing remains to be adjudicated as against him. Thus, this Court,
without expressing any opinion with regard to the legality and propriety of the order passed by the tribunal, disposes of the writ petition directing the opposite parties to extend the benefits, as due and admissible to the petitioner, after his retirement. 6.
Issue urgent certified copy as per rules.
