This matter is taken up through Hybrid Mode.

Heard learned counsel for the parties.

The petitioner is seeking pre-arrest bail in connection with Badampahar P.S. Case No. 19 of 2021 corresponding to C.T. Case No. 167 of 2021, pending on the file of the learned SDJM, Rairangpur for commission of offence under Sections 379/411 of the I.P.C. read with Sec. 18 of the Odisha Minerals Prevention of Theft, Smuggling and Illegal Mining and Regulation of Possession, Storage, Trading and Transportation) Rules, 2007. 4.

Taking into account the nature of allegation, it is directed that on surrendering within three weeks hence and moving for bail, the petitioner shall be released on bail by the learned court in seisin over the matter on such terms as deemed just and proper. 5.

It is stated by learned counsel for the petitioner that the petitioner has no criminal proclivity. While enlarging the petitioner

on bail the learned court below shall verify such assertion. If it comes to the fore that the petitioner has any criminal antecedent, this order shall stands recalled automatically without any further reference to this Court.

Accordingly, the ABLAPL is disposed of.
