This matter is taken up through hybrid mode.

This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the criminal proceeding initiated against him vide G.R. Case No.267 of 2014, arising out of Sambalpur Town P.S. Case No.39(06) of 2014, pending in the court of S.D.J.M., Sambalpur. 3.

Heard Mr. Sarada Prasanna Sarangi, learned counsel appearing for the Petitioner and Mr. Prem Kumar Pattnaik, learned Additional Standing Counsel appearing for the StateOpposite Party No.1. 4.

Since the F.I.R. allegation discloses a cognizable offence, I am not inclined to entertain the prayer made in this petition.

Accordingly, the CRLMC stands dismissed.

However, since the F.I.R. is of the year 2014 and investigation in the aforesaid case yet to be completed, the Investigating Authority shall do well to conclude the investigation as expeditiously as possible, preferably not later than eight months from the date of receipt of this order inasmuch as expeditious investigation is also one of the facets of fundamental rights traced in Article 21 of the Constitution of India.
