This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.1272 of 2021, on the files of learned S.D.J.M., Bargarh, arising out of Ambabhona P.S. Case No.188 of 2021, under Sections 420/ 500/ 354(C)/ 376(2)(n)/ 417/ 34 of I.P.C. read with Section 66(E)/67(A) of the IT Act, 2000 and is in custody since 23.11.2021. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Bargarh, by order dated 23.03.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the 164 Cr.p.C. statement of the victim and considering that charge sheet has already been filed and the period of custody, this Court directs the petitioner to be released

on bail. The learned Court in seisin to fix the terms to ensure the presence of the petitioner on each date of trial and it goes without saying that the petitioner shall not in any way try to intimate the victim or her family.

Accordingly, the BLAPL stands disposed of.
