CORAM:

JUSTICE JASWANT SINGH JUSTICE M. S. SAHOO Order No.

ORDER (Oral) 11.02.2022 02.

1. This matter is taken up through virtual/physical mode.

2. The petitioner is the defaulting borrower and has laid challenge to the two demand notices of even date in two loan accounts seeking to recall the outstanding liabilities of Rs.1,70,778/- and Rs.1,37,054/- respectively, on account of the loan accounts having been declared NPA by the State Bank of India due to default in payments.

3. None has come present.

4. It is apparent that notice was not issued in the present case and by efflux of time nothing would have survived, apart from the fact that no writ petition is maintainable against the notice issued under Section 13(2) of the SARFAESI Act, 2002.

5. In view of the above, the writ petition is dismissed. (Jaswant Singh) Judge (M.S. Sahoo) Judge February 11th, 2022 Cuttack Basudev
