This matter is taken up through hybrid mode.

Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are seeking pre-arrest bail in connection with G.R. Case No.247 of 2022 arising out of Paradip Lock P.S. Case No.63 of 2022 pending in the Court of learned J.M.F.C.(P) Kujanga for commission of offence punishable under Sections 452/341/294/323/324/307/506/34 of the IPC.

Taking into account the submission of the learned counsel for the State on the basis of the recitals in the case diary that petitioner No.3 has criminal proclivity, this Court is not inclined to exercise its discretion in respect of Petitioner

No.3. The ABLAPL accordingly stands rejected qua the Petitioner No.3.

Considering the submissions made by the learned counsel for the petitioner and State, it is directed that on surrendering within three weeks hence and moving for bail, the Petitioner Nos.1 and 2 shall be released on bail by the learned Court in seisin over the matter on such terms as deemed just and proper.

Accordingly, the ABLAPL stands disposed of.
