This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel for the State. 3.
The petitioner is seeking pre-arrest bail in connection with C.T. Case No.556 of 2009 arising out of Jaleswar P.S. Case No.277 of 2009 pending in the Court of learned J.M.F.C. Jaleswar for commission of offence punishable under Sections 450/376/324/201/34 of the IPC.

Perused the affidavit filed by the informant indicating inter alia that the matter has been compromised. Paragraph-3 and 4 of the affidavit are quoted hereunder for convenience of ready reference;

That the disputed fact between me and with the petitioner Rabindra Gaana @ Gan have been made amicable settlement on intervention of my family members so also village gentries in the mean while during pending disposal of the present case and now we are all living together in leading to our happy familiar life.
4. That in view of the above development I am no more interest to proceed with the criminal case (above case) against my elder brighter-in-law (Dedhasura)/Petitioner and accordingly if the petitioner will be released on bail advance then I have no objection at all." x x x x x 5.
Taking into account that the affidavit as aforesaid, this Court directs that on surrendering within three weeks hence, the petitioner shall be released on bail. The Court in seisin to fix the terms.

Accordingly, the ABLAPL stand disposed of.
