Counter affidavit on behalf of OPs.2 & 3, Council of Higher Secondary Education filed on 05.05.2022 is referred to by the learned counsel for OPs.2 & 3.

Registry to bring the affidavit by CHSE on record. Copy of the counter is herein referred to after being produced by learned counsel for the petitioner. Learned counsel for the petitioner as well as learned counsel for CHSE have referred to paragraphs 5, 6 & 9 of the counter affidavit.

It is averred in paragraph-9 that 16 students out of 78,077 students, in the +2 Science, have opted for Economics as elective paper. The elective paper of Economics has been scheduled to be held on 10.5.2022 due to notification of All India JEE Main Examination. 5.
In such view of the matter, since the examination is to be held on 10.5.2022, at this stage, the examination schedule may not be disturbed only for the 16 science students and the students should appear on the scheduled

However, before parting with the case, it is observed that the examination for Science students could have been better scheduled inasmuch as that the only possible schedule could not be 10.05.2022 and 11.05.2022 on consecutive dates, at least, for an example it could have been the last date of the schedule proposed/advised by the Govt. i.e from 28.04.2022 to 24.05.2022, i.e. 24.05.2022. The object for any examining body like CHSE has to be to give the maximum possible time to the students to prepare for each paper to make it less stressful. There is nothing unsual that students would choose any available subject like economics as elective.

The writ petition is disposed of accordingly. (M.S. Sahoo) Judge
