Considering the submission made by Mr. Behera, learned counsel for Petitioner, this Court directs, provided there is no legal impediment in proceeding with the F.D.(I) No.256 of 2005, all attempt shall be made by the learned Civil Judge (Sr. Divn.), 1st Court, Cuttack to conclude the proceeding vide F.D.(I) No.256 of 2005 at least within a period of six months from the date of communication of an authenticated copy of this order by the Petitioner. 2.

The Civil Miscellaneous Petition stands disposed of with the above direction.
