This matter is taken up through hybrid arrangement (virtual/physical) mode.

This is the successive journey of the Petitioner, who is in custody in connection with EOW Bhubaneswar P.S. Case No.08 of 2016 corresponding to C.T. Case No.05 of 2016 now pending in the Court of the learned P.O, Designated Court under OPID Act, Cuttack running for the alleged commission of offence under Section 467/468/471/420/406/120-B of the IPC read with section 4/5/6 of the PCMC (B) Act, in filing this application under section 439 Cr.P.C. for consideration of his prayer for grant of bail in the above mentioned case.

Upon hearing the leaned counsel for the Petitioner and learned State Counsel, the record being perused, it is seen that the Petitioner had last moved the Trial Court, praying for his release on bail on 24.04.2020. In view of long lapse of about more than two

// 2 // years by now; this application stands disposed of granting liberty to the Petitioner to approach the Trial Court afresh for his release on bail citing all the developments which have taken place in the meantime for their consideration in proper perspective. It is needless to observe that in the event such a move is made, the Trial Court would do well to consider the same on its own merit; further taking into account all such developments which have taken place in the meantime in their proper perspective and dispose of the same early in accordance with law. 4.

The BLAPL is accordingly disposed of.
