This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Heard learned counsel for the Petitioner as well as learned counsel for the State.

The writ petition filed with the following prayer: Under these circumstances, the petitioner most respectfully prays that this Hon'ble Court may be graciously pleased to issue a writ or writs in the Nature of "Writ of Mandamus" directing the Opp.
Parties more particularly the Administrator, Primary agriculture Cooperative Society (PACS) ltd., Lakhna (O.P. No.5) to consider and dispose of the appeal under Annexure-3 which is still pending before him since 17.6.2021 within a stipulated period of time that may be fixed by this Hon'ble Court."

Learned counsel for the Petitioner submits that ventilating his grievance, Petitioner has filed an appeal before the Administrator, Lakhna PACS Ltd., Opposite Party No.5, dated
// 2 // 17.06.2021. It is submitted that the said appeal is pending before the Authority till date and no decision has been taken on the same. 5.
Learned counsel for the State on the other hand submits that he has no objection if a direction is given to the Appellate Authority to consider and dispose of the said appeal of the Petitioner within specific period of time.

Considering the limited nature of grievance and considering the facts and circumstances of the case, this Court directs the Opposite Party No.5 to consider the appeal of the Petitioner dated 17.06.2021 (Annexure-3) strictly in accordance with law within a period of two months from the date of receipt of certified copy of this order. The Opposite Party No.5 shall dispose of the same by passing a speaking and reasoned order. Decision so taken be communicated to the Petitioner within a period of two weeks thereafter.

With the above direction, the writ petition stands disposed of.

Issue urgent certified copy of this order on proper application.
