This matter is taken up through virtual/physical mode. 2.

The Petitioner, a defaulting borrower, by filing the present writ petition has sought for a direction to the Collector & District Magistrate, Sambalpur to restrain the secured creditor/Bank from taking forcible possession of the secured assets, as the effort is to give possession to the auction purchaser.

At the time of hearing, counsel for the Bank states that the present writ petition has become infructuous as the actual physical possession of the secured assets has been taken by following the process of law as per the direction passed by the Collector & District Magistrate, Sambalpur on an application under Section 14 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 moved by the secured creditor/Bank.
