1. This matter is taken up through hybrid mode.

2. Heard learned counsel for the Petitioners and learned Addl. Standing Counsel for the State.

3. The petitioners are in custody since 11.03.2022 in connection with Jharsuguda P.R. No.142 of 2021-22 corresponding to 2(a)CC Case No.2 of 2022 pending in the Court of learned Special Judge, Jharsuguda for the alleged commission of offence under Sections 20(b)(ii)(C) of NDPS Act.

4. The Petitioners were found to be in possession of

// 2 // contraband ganja weighing 34 kg while they were present at the ticket counter at Jharsuguda Railway Station. It is submitted that the seizure was made from a public place and the entire allegations are false and baseless. It is further submitted that the police had seized two unclaimed bags and entangled the petitioners in this case.

5. Considering the submissions as above and the materials on record, I am inclined to allow the prayer for bail. Let the petitioners be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that they shall personally appear before the trial Court on each date of posting of the case without fail. Further, Petitioner No.1 shall furnish cash security of Rs.50,000/-(Rupees Fifty Thousand) in the shape of short term fixed deposit in any Nationalised Bank being pledged to the court below, he shall provide his present address and mobile number to the I.O. and if any changes therein shall also be intimated to the I.O. and he shall not leave the jurisdiction of the court without special permission from the court

6. The BLAPL is disposed of.

7. Urgent certified copy of this order be granted on proper application.
