This matter is taken up through hybrid mode.

The petitioner has filed this writ petition seeking to quash the impugned E-Tender notice dated 22.03.2022 bearing NIT No.MCL/SBP/GM(CMC)/NIT-846/2022/990 under Annexure-1, and to issue direction to the opposite parties to consider representations under Annexures-11 and 12 within a stipulated time.

Mr. A. Pattnaik, learned counsel for the petitioner states that vide letter dated 15.02.2022 under Annexure-11 the petitioner has already expressed its consent to execute the 20% extra even more than the awarded quantity under the contract awarded against NIT-831 dated 26.05.2021, and also requested the authority to consider the tender vide Annexure-12 dated 30.03.2022, which are still pending adjudication. Therefore, direction may be given to the authorities to consider the same within a stipulated time. 4.

Mr. Mohanty, learned counsel appearing for the opposite parties-MCL states that since the petitioner has approached the

authorities vide Annexure-11 and 12, direction may be given to the authorities to consider the same and pass appropriate order in accordance with law.

Having heard learned counsel for the parties and after going through the records, since the petitioner has already expressed its consent to execute the 20% extra even more than the awarded quantity under the contract awarded against NIT-831 dated 26.05.2021 vide Annexure-11, and also requested the authority to reconsider the tender vide Annexure-12 dated 30.03.2022, this writ petition stands disposed of directing opposite party no.2 to consider the grievance made by the petitioner as at Annexures-11 and 12, by passing a reasoned and speaking order in terms of the detail tender call notice/agreement executed between the parties, as expeditiously as possible, preferably within a period of four weeks from the date of production of certified copy of this order. Issue urgent certified copy as per rules.
