Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in T.R. Case No.15 of 2021, on the files of learned Sessions Judge, Nabarangpur, arising out of Kosagumuda P.S. Case No.39 of 2021, U/s.20(b)(ii)(c) and read with Section 29 of the NDPS Act. 4.
Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Nabarangpur, by order dated 08.03.2021 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the State refutes such submission and prays for rejection of prayer for bail.

Taking into account the submission of the learned counsel for the petitioner that in view of the nature of seizure exclusive conscious possession cannot be attributed to the petitioner, it is directed that the petitioner shall be released on bail on such terms to be fixed by the learned Court in seisin of the matter 7.
Accordingly, the BLAPL stands disposed of.
