Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is seeking pre-arrest bail in connection with G.R. Case No. 740 of 2008, arising out of Berhampur Sadar P.S. Case No. 140 of 2008 pending in the Court of learned S.D.J.M., Berhampur for the alleged commission of offence punishable under Sections 457/380/114/34 of the I.P.C. 4.

Taking into account the nature of allegation, It is directed that in the event, the petitioner surrenders within four weeks hence, the learned Court in seisin over the matter shall consider

the application on its own merits. While doing so, the learned Court may take into account release of the other co-accused. 5.

Accordingly, the ABLAPL stands disposed of.
