This matter is taken up through hybrid arrangement (virtual/physical mode).

The defaulting loanee is before this Court challenging the publication of Notice dated 18th January, 2013 issued by the State Bank of India, Regional Office, Bhubaneswar under Section 13(4) of the SARFAESI Act, assuming symbolic possession of the secured asset for recovery of an outstanding liability of Rs.5,99,936/- as on 7th June, 2012.

3. The record bears out that this Court vide interim order dated 12th March, 2013 had passed the following order:

"Heard.

Issue notice as above.

Accept one set of process fee.

As an interim measure, this Court directs the opposite party not to take any coercive action against the petitioner till 10.4.2013, subject to the petitioner depositing a sum of Rs.70,000/- (rupees seventy thousand) before the opposite party in two equal installments, the 1st one of which be deposited on or before 29.3.2013 and the 2nd on or before 15.4.2013."

At the time of hearing, learned counsel for the petitioner has filed a Memo seeking unconditional withdrawal of the Writ Petition. The Memo be kept on record.

In view of the Memo filed, the Writ Petition is dismissed as withdrawn.
