1. In the counter affidavit filed on behalf of O.P.No.2 way back on Order No.

18th July, 2015 it has been clarified in para-7 as under: "7. That in reply to the averments made in para 3 of the writ application it is submitted that no permission has been given/granted to M/s. Mahindra Satyam i.e. opposite party No.3, to develop any greenery work over the land of the petitioner vide khata no.1426/1449 in plot no.17/4879 and plot no.21/4878 as the same has been allotted in favour of the petitioner by the G.A. Deptt. Govt. of Odisha, as stated by the petitioner, for the purpose of Hotel Business in the name and style of Hotel Rashmi Plaza, Bhubaneswar."

2. In view of the above clarification which has not been contradicted by the Petitioner by filing a rejoinder till date, there is no merit in the present writ petition. It is dismissed as such.
