1. This matter is taken up through hybrid mode. Order No.

2. Heard learned counsel for the Petitioners and learned Addl. Standing Counsel for the State.

3. The Petitioners are in custody since 16th November, 2019 in connection with Mathili P.S. Case No.48/2018 corresponding to G.R. Case No.210/2018 pending in the court of learned J.M.F.C., Mathili for the alleged commission of the offence under Sections 147/148/302/120-B/149 of the I.P. C. read with Sections 18/20/22 of UAP Act and Section 25 of the Arms Act.

4. It is alleged that the Petitioners being naxalities committed murder of one Jagadish Samarath by severely assaulting him and causing gunshot injuries after tying his hands to his back. No one has been named in the F.I.R. There are no acceptable materials to show the complicity of the present Petitioners in the occurrence.

5. Considering the submissions made, the materials on record and the fact that similarly placed co-accused persons have already been released on bail as per orders passed by this Court in BLAPL Nos.7849/2019, 6471/2020 and 10725/2021, I am inclined to allow the prayer for bail.

6. Let the Petitioners be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that they shall appear before the trial court on each date of posting of the case without fail.

7. The BLAPL is disposed of.

8. Urgent certified copy of this order be granted on proper application.
