Heard Mr. B. Satpathy, learned Counsel appearing for the Petitioner and Mr. S. Jena, learned Standing Counsel for School and Mass Education Department.

The Petitioner has filed this Writ Petition seeking to quash the order dated 25.04.2012 passed by the Odisha Administrative Tribunal in O.A. No. 215 of 2011 under Annexure-1, and to issue direction to the opposite party no.1 to approve his appointment and release his salary from December, 2007 and current salary within a stipulated time.

In course of hearing, learned Counsel for the Petitioner states that the Petitioner has already made representation before the Opposite Party no.1 vide Annexure-9, and the same may be directed to be disposed of within a stipulated time taking into consideration the order dated 17.11.2005 passed by this Court in W.P.(C) Nos. 5865 of 2004 and W.P.(C) No. 14895 of 2004, which has been affirmed by the apex Court in S.L.P.(C) No. 015749-15750/2009 and S.L.P.(C) No. 006880-006881/2009, vide order dated 18.05.2009 and 07.07.2009 respectively, to which
learned Standing Counsel for School and Mass Education Department.

As agreed by learned counsel for the parties and after going through the records, this Court, without expressing any opinion on the merits of the case, disposes of the Writ Petition directing Opposite Party no.1 to consider the representation filed by the Petitioner vide Annexure-9, taking into consideration the order dated 17.11.2005 passed by this Court in W.P.(C) Nos. 5865 of 2004 and W.P.(C) No. 14895 of 2004, which has been affirmed by the apex Court in S.L.P.(C) No. 015749-15750/2009 and S.L.P.(C) No. 006880-006881/2009, vide order dated 18.05.2009 and 07.07.2009 respectively, and pass appropriate order in accordance with law within a period of three months from the date of production of certified copy of this order. Issue urgent certified copy as per Rules.
