This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The Petitioner is an accused in connection with Chauliaganj P.S. Case No.329 of 2021 corresponding to G.R. Case No. 1139 of 2021(S.T. Case No.220 of 2021) on the file of learned CJM-cum-ASJ, Cuttack, registered for the alleged commission of offence under Sections 341/323/294/506/307 of the I.P.C.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned Sessions Judge, Cuttack (Incharge), by order dated 6.04.2022, the present BLAPL has been filed 5.

Considering that admittedly trial has commenced and criminal proclivity of the petitioner as stated by learned counsel for the State on the basis of recitals in the case diary, this Court is not inclined to entertain this bail application at this stage. .

Accordingly, the BLAPL stands rejected.

Since six witnesses have been examined, learned court in seisin over the matter shall expedite the trial and conclude the same within a period of two months from the date of receipt/production of certified copy of this order.
