1. This matter is taken up through virtual mode. Order No.

2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

3. The Petitioner is in custody since 17th February, 2022 in connection with Bolagarh P.S. Case No.37/2022 corresponding to G.R. Case No.281/2022 pending in the court of learned S.D.J.M., Khurda for the alleged commission of the offence under Sections 341/294/323/324/307/506/34 of the I.P.C.

It is submitted that even as per the F.I.R, which was lodged by the wife of the injured, the Petitioner is alleged to have abused her husband in obscene language and also attempted to kill by means of a sword, but he was prevented from doing so being caught by the villagers. While the Petitioner was being taken to the Police Station, some other persons came on motor cycles being armed with deadly weapons and assaulted the injured causing brutal inquiries. In so far as the present Petitioner is concerned, there is absolutely no allegation that he had caused the injuries on the injured.

5. Taking into consideration all the above facts and the period of detention in custody, I am inclined to allow the prayer for bail. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear before the trial court on each date of posting of the case without fail.

6. The BLAPL is disposed of.

7. Urgent certified copy of this order be granted on proper application.
